Acceptance of Terms

By accessing and using Nepal Edu Marketplace platform, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by the above, please do not use this service.

These terms are governed by the laws of Nepal, including but not limited to the Electronic Transaction Act, 2063 (2008) and the Information Technology Act of Nepal.

Service Description

Nepal Edu Marketplace is an educational platform that connects students with tutors and educational institutions across Nepal. We provide:

  • Communication between students and instructors
  • Educational content and resources
  • Course enrollment and management services
  • Access to online and offline tuition classes

User Registration and Account

To access certain features of the platform, you must register for an account. You agree to:

  • Be responsible for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account
  • Maintain the security of your password and account
  • Maintain and update your information to keep it accurate and current
  • Provide accurate, current, and complete information during registration

Users must be at least 13 years old to create an account. For users under 18, parental or guardian consent is required.

Payment Terms

All payments are processed in Nepali Rupees (NPR) unless otherwise specified. By enrolling in paid courses:

  • You agree to pay the course fees as displayed at the time of enrollment
  • Payment methods accepted include eSewa, Khalti, bank transfer, and other approved payment gateways
  • All fees are subject to applicable taxes as per Nepal tax laws
  • Refunds are processed according to our refund policy

Teacher Payout and Tax Policy

Important information for educators earning through our platform

For instructors and teachers earning income through the Nepal Edu Marketplace platform, the following terms apply:

9.1 Tax Deduction at Source (TDS)

In accordance with the Income Tax Act, 2058 (2002) of Nepal and regulations set forth by the Inland Revenue Department (IRD), all payments made to teachers will be subject to Tax Deduction at Source (TDS).

TDS Rate: 15% of the gross payment amount will be deducted as TDS before processing the payout to the teacher.

Example: If a teacher earns NPR 10,000, NPR 1,500 (15%) will be deducted as TDS, and the net payout will be NPR 8,500.

TDS Certificate: Teachers will receive a TDS certificate for the deducted amount, which can be used for income tax filing purposes.

9.2 PAN (Permanent Account Number) Requirement

As per Nepal tax regulations, all teachers must provide a valid Permanent Account Number (PAN) to receive payouts:

Mandatory Requirement: A valid PAN issued by the Inland Revenue Department of Nepal is mandatory for all teachers receiving payments through the platform.
Verification: Teachers must submit their PAN details during registration or before requesting their first payout.

Non-Compliance Consequences:

  • ×Withholding of all pending payouts until PAN is provided
  • ×Potential higher TDS deduction as per IRD regulations for non-PAN holders
  • ×Inability to access payout features on the platform

9.3 Payout Processing

  • Payouts will be processed monthly or as per the agreed schedule
  • Net amount (after TDS deduction) will be transferred to the teacher's registered bank account or approved payment method
  • Payment gateway charges, if any, may be deducted from the payout amount
  • Detailed payout statements showing gross earnings, TDS deduction, and net payout will be provided

9.4 Tax Compliance

Teachers are responsible for:

  • Filing their annual income tax returns with the Inland Revenue Department
  • Maintaining proper financial records of all earnings from the platform
  • Claiming TDS credit while filing income tax returns using the provided TDS certificates
  • Complying with all applicable tax laws and regulations of Nepal

Nepal Edu Marketplace acts only as a facilitator for tax collection as required by law. Teachers should consult with a tax professional for specific tax advice.
